Trustco Bank reached a $2.75 million class action settlement to resolve claims it improperly charged some customers overdraft fees called Retry NSF fees or APSN fees.
The Trustco Bank class action settlement benefits current and former account holders whom Trustco charged certain fees on specific transactions between Sept. 2, 2014, and Dec. 10, 2023.
Plaintiffs in the Trustco Bank class action lawsuit claim the bank improperly charged them and other customers Retry NSF fees and APSN fees, violating their account holder agreements. Retry NSF fees refer to multiple overdraft fees imposed on the same ACH transaction or check after the initial fee. APSN fees are assessed on debit card transactions that had sufficient funds at the time of authorization but were posted later when the account balance was insufficient.

Trustco Bank is a regional bank that offers a variety of financial products and services, including personal and business banking, loans, mortgages and investments.
Trustco Bank denies any liability or wrongdoing but agreed to the $2.75 million settlement to resolve the litigation.
Under the terms of the Trustco Bank class action settlement, class members will receive a payment based on the number of at-issue fees they incurred. Those with open accounts will receive a direct credit to their account, while those with closed accounts will receive a check mailed to their residence.
The deadline to exclude yourself or opt out of the settlement was Oct. 21, 2024.
The deadline to object is Nov. 12, 2024.
The final approval or fairness hearing is scheduled for Nov. 26, 2024.
There is no claim form deadline. Any amount you are entitled to will be distributed to you unless you choose to exclude yourself.
